5. How Enquiries and Forms Are Handled

When you submit a form on this website, your details are:

  • received by Stewart Thomson Property via email notification
  • stored in our CRM system (Capsule CRM) for enquiry management
  • tagged by enquiry type so we can respond appropriately

You will receive a confirmation message acknowledging your enquiry. We will follow up directly using the contact details you provide. We do not pass enquiry data to third parties for their own marketing purposes.

6. Storage and Retention

Your data is stored securely using the following systems:

  • Google Workspace (Gmail and Drive) for email and document handling
  • Capsule CRM for contact and enquiry management
  • This website and its hosting provider

We retain your data for as long as it is relevant to our business relationship or as required by law. As a general guide:

  • Active enquiry contacts: retained while the enquiry or relationship is live
  • Completed transactions or arrangements: retained for up to 7 years for legal and financial record purposes
  • Unactioned enquiries with no ongoing contact: reviewed and cleared periodically

You can ask us to delete your data at any time. See Section 8 for your rights.

7. Sharing with Third Parties

We do not sell your personal data. We share data only where necessary with:

Service providers

Google Workspace (email and document storage), Capsule CRM (contact management), our website hosting provider and any automation tools used to manage enquiry routing. These providers process data only on our instructions.

Legal or regulatory obligations

Where we are required to disclose information by law, court order or regulatory authority.

Professional advisers

Solicitors, accountants or other advisers where relevant to a specific transaction or matter, and only to the extent required.

No personal data is transferred outside the UK or EEA without appropriate safeguards in place.

12. Sourcing Clients

This section applies if you instruct Stewart Thomson Property to source a property for you. Stewart Thomson Property is a trading name of RNC Redevelopments Limited (company number SC704186), which is the data controller. ICO registration number: ZC171078.

If you don’t give us these details, we can’t source a property for you. Send your documents by email to st@stewartthomsonproperty.com, not through a form on this website.

What we collect

  • your name, address, email and phone number
  • photo identification, such as a passport or driving licence
  • proof of address
  • evidence of where your money comes from, such as bank statements, a mortgage offer or sale proceeds
  • if you buy through a company: its incorporation details, directors and anyone who owns more than 25%, some of which we get from Companies House
  • your property brief: budget, areas, timescale and how you’re funding the purchase

Why we collect it

  • To check who you are, to prevent fraud and financial crime, and to check where the money for your purchase comes from. Lawful basis: legitimate interests, being our interest in preventing fraud and financial crime.
  • To deliver the sourcing service you’ve signed up for. Lawful basis: contract.

Who we share it with

  • your solicitor and the seller’s agent, only as needed for your purchase
  • our service providers listed in Section 7, including Google (document storage)
  • regulators, law enforcement or other authorities, where the law requires it or where we need to share information to prevent or detect crime

We check your identity by hand. We don’t use an automated identity verification service. We don’t sell your data. We only send you marketing where the law allows, and you can opt out at any time.

How long we keep it

Identity and source of funds records: 5 years from the end of our working relationship, so we can deal with any fraud concern or legal claim. Complaint records: 3 years. Everything else: up to 7 years after your purchase completes or you stop using our service.

How we keep it safe

We store your documents in Google Drive. Access is limited to Stewart Thomson Property and to anyone we share a document with for your purchase, such as your solicitor.

Transfers outside the UK

We don’t deliberately send your information outside the UK. Google, which provides our document storage, may store or access data on servers in other countries, including the United States. Where it does, the transfer is protected by the safeguards Google uses under UK data protection law. You can ask us for a copy of these safeguards.

Your rights

Your rights are set out in Section 9. Where we need to keep records to meet a legal obligation or to defend a legal claim, we keep them for the periods above even if you ask us to delete them.
